The Platform is owned by Well Earth India, a company registered under the Udyam Registration (UDYAM-RJ-15-0047519) with its registered office at 7 KSD, Raisinghnagar, Sri Ganganagar, Rajasthan 335051 (hereinafter referred to as ‘Platform Owner’, 'we', 'us', 'our').
Your use of the Platform and services and tools are governed by the following terms and conditions (“Terms of Use”) as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, You shall be contracting with the Platform Owner and these terms and conditions including the policies constitute Your binding obligations, with Platform Owner.
These Terms of Use relate to your use of our website, goods (as applicable) or services (as applicable) (collectively, 'Services'). Specifically, Well Earth India provides a Plantation-as-a-Service (PaaS) model where customers pay for the long-term management, maintenance, and protection of trees on our managed sites.
Specific Use of Platform and Services
True Information
To access and use the Services, you agree to provide true, accurate and complete information to us during and after registration, including the details for any gift recipients or memorial dedications.
Disclaimer of Warranty
Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information offered through the Services. You acknowledge that such information and materials (including Geo-tag coordinates) may contain inaccuracies or errors.
Risk & Responsibility
Your use of our Services and the Platform is solely and entirely at your own risk. It is your responsibility to independently ensure that our PaaS model meets your requirements.
Proprietary Rights
The contents of the Platform, including the design, layout, look, graphics, and Digital Certificate templates, are proprietary to us. You will not have any authority to claim any intellectual property rights in its contents.
Service Charges
You agree to pay us the charges associated with availing the Services. As a service provider, Well Earth India assigns a pre-planted tree to your order immediately upon payment.
No Ownership
You understand that upon initiating a transaction, you are entering into a legally binding contract for a service. This does not grant you or any recipient ownership or title to the physical land or the timber.
Indemnification
You shall indemnify and hold harmless Well Earth India and its officers from any claim or demand arising out of your breach of these Terms or your violation of any law or the rights of a third party.
Force Majeure
Well Earth India shall not be liable for any failure to perform obligations (such as tree maintenance) if performance is prevented or delayed by a force majeure event (natural disasters, total drought, etc.).
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Raisinghnagar, Sri Ganganagar, Rajasthan.
